These Terms and Conditions set out the rules for using the services of the private speech and language therapy practice operating under the name Polski logopeda w Holandii, run by Anna Maria Twarogowska.

Use of the Practice's services constitutes acceptance of the rules set out in these Terms and Conditions.

2. SCOPE OF SERVICES

The Practice provides private speech and language therapy services, in particular:

  • speech and language therapy consultations,
  • speech and language assessments,
  • speech and language therapy,
  • consultations for parents and carers,
  • preparing recommendations for practice at home,
  • preparing reports or written opinions, where this has been agreed in advance,
  • online therapy and consultations, where this form has been agreed with the client.

The scope and manner of therapy are determined individually on the basis of the client's needs and the assessment and observations carried out.

The Practice provides its services privately and does not bill health insurers directly.

3. BOOKING APPOINTMENTS

The date and time of an appointment are agreed individually with the client or their parent/legal guardian.

A booked appointment is reserved exclusively for the client concerned.

The client or their parent/legal guardian is required to arrive punctually for the appointment.

Where therapy takes place on a regular basis, the Practice may propose a fixed day and time for sessions.

4. BOOKING AND PAYMENT FOR THE FIRST APPOINTMENT

To confirm and reserve the first appointment, the client or their parent/legal guardian is required to pay 50% of the price of the first appointment.

This payment constitutes a partial prepayment for the first appointment and is credited towards its total cost.

The first appointment is definitively reserved once the required payment has been received within the period specified by the Practice.

The remaining 50% of the price of the first appointment must be paid immediately after the appointment by debit card (PIN) or in cash.

If the booking payment is not received within the specified period, the Practice may cancel the booking and offer the appointment slot to another client.

5. PAYMENT FOR SUBSEQUENT APPOINTMENTS

For each subsequent appointment, the client or their parent/legal guardian pays the full price immediately after the appointment.

Payment can be made:

  • by debit card (PIN),
  • in cash.

Prices for services are set out in the Practice's current price list.

The client should be informed of the price of a service before it is provided.

6. CANCELLING AND RESCHEDULING APPOINTMENTS

Any appointment may be cancelled or rescheduled free of charge no later than 24 hours before the scheduled time.

If the first appointment is cancelled at least 24 hours before the scheduled time, the 50% of the price paid in advance will, at the choice of the client or their parent/legal guardian:

  • be refunded, or
  • be credited towards another agreed appointment.

If the first appointment is rescheduled with at least 24 hours' notice, the payment may be transferred to the new appointment.

7. LATE CANCELLATION AND NON-ATTENDANCE

If an appointment is cancelled less than 24 hours before it is due to start, or if the client does not attend without prior cancellation, the client or their parent/legal guardian is required to pay 100% of the price of the booked appointment.

For the first appointment, the 50% of the price paid in advance is credited towards the amount due and the remaining 50% must be paid.

For subsequent appointments, the full price of the booked appointment is charged in accordance with the current price list.

The charge relates to the reserved time, which, in the case of late cancellation, usually cannot be offered to another client.

In exceptional circumstances beyond the client's control, the Practice may waive all or part of the charge. Each such situation is considered individually.

8. LATE ARRIVAL

If the client arrives late, the appointment may be shortened by the length of the delay so as not to delay subsequent appointments.

Late arrival does not reduce the price of the appointment.

If the delay is so long that holding the appointment is no longer justified from a therapeutic or organisational point of view, the Practice may deem the appointment impossible to hold.

The Practice will make every effort to ensure that appointments start on time. If a delay is caused by the Practice, the client will not lose the therapy time to which they are entitled, insofar as this is organisationally possible.

9. ABSENCES AND REGULAR ATTENDANCE

Regular attendance is an important condition for the effectiveness of therapy.

The client or their parent/legal guardian undertakes to attend the agreed appointments as regularly as possible.

If the number of absences is high, in particular where the client is absent from around 70% of the scheduled appointments in a given month, the Practice may contact the client or their parent/legal guardian to discuss whether therapy can continue.

Repeated absences, lack of contact or a continuing inability to attend therapy regularly may give grounds for reassessing whether continued cooperation is appropriate and feasible.

Before deciding to end therapy, the Practice will, where circumstances permit, inform the client or their parent/legal guardian of the problem and give them the opportunity to improve attendance.

Any ending of therapy takes place in accordance with the applicable legal provisions and with due care.

10. CANCELLATION BY THE PRACTICE

In the event of illness of the speech and language therapist, an unforeseen event or other circumstances that make it impossible to hold the appointment, the Practice may cancel or reschedule the appointment.

The client will be informed of this as soon as possible.

The client will not incur any costs for an appointment cancelled by the Practice.

If the first appointment has already been partly paid for, the amount paid will, as agreed with the client, be refunded or transferred to another appointment.

11. CLIENT ILLNESS

In the case of an infectious disease, fever or other symptoms that may pose a risk to the speech and language therapist or to other people using the Practice, it is recommended that the appointment be rescheduled.

If the client's state of health may hinder active participation in therapy, it is also advisable to contact the Practice in advance.

The rules set out in these Terms and Conditions apply to cancellations due to illness; however, in special and urgent cases, the Practice may, on an individual basis, waive the late cancellation charge.

12. COURSE OF THERAPY

The speech and language therapist selects methods, exercises and therapy materials appropriate to the client's needs and abilities.

The rate of progress is individual and depends on many factors; the Practice therefore cannot guarantee that a specific therapy outcome will be achieved within a specific period.

Regular practice at home in line with the recommendations provided may be an important part of therapy.

Failure to follow recommendations, irregular attendance or other factors beyond the speech and language therapist's control may affect the pace and outcomes of therapy.

13. PRESENCE OF A PARENT OR LEGAL GUARDIAN

For therapy with a child, the way in which the parent or legal guardian takes part is agreed individually.

Depending on the child's age, the aim of the therapy and the way it is carried out, the parent may take part in the sessions, be asked to remain in the waiting room, or receive information and recommendations at the end of the session.

The parent or legal guardian is required to provide the speech and language therapist with relevant information about the child's health, development or circumstances that may be significant for therapy.

14. CLIENTS WHO ARE MINORS

For clients who are minors, the rules arising from applicable law apply.

Insofar as the provisions of the WGBO (Dutch Medical Treatment Contracts Act) apply:

Children under 12

Decisions regarding therapy are, as a rule, made by the parents with parental authority or by the legal guardian.

Children aged 12 to 15

Both the child and their parents or legal guardians have certain rights regarding therapy. In cases provided for by law, consent to therapy may be required from both the child and the parent or legal guardian.

Clients aged 16 and over

A client who has reached the age of 16 decides independently, in accordance with the rules of the WGBO, on their therapy and on access to their records.

Parents or legal guardians have no automatic right to information about the therapy or to inspect the records, unless the client consents to this.

15. ENDING THERAPY

Therapy may be ended, among other things:

  • once the agreed therapy goals have been achieved,
  • when further speech and language therapy is not indicated at that time,
  • with the consent of the client or their parent/legal guardian,
  • at the request of the client or their parent/legal guardian,
  • when referral of the client to another specialist is appropriate,
  • in the event of a persistent lack of cooperation or regularity that prevents therapy from being carried out properly, taking into account the applicable legal provisions.

If cooperation is ended at the initiative of the Practice, this is done with due care and with regard to the client's interests.

16. CONTACT WITH OTHER SPECIALISTS, SCHOOL OR NURSERY

If contact with another specialist, a school or a nursery is relevant to the assessment or therapy process, the Practice may suggest such contact.

If sharing information requires the consent of the client or their parent/legal guardian, consent will be obtained before any data is shared.

Only information that is necessary for the specific purpose is shared.

17. RECORDS AND DATA PROTECTION

Clients' personal data and health information are processed in accordance with the applicable data protection legislation.

Detailed rules are set out in the Practice's Privacy Policy.

The Privacy Policy is available on the Practice's website.

18. PHOTOGRAPHS, RECORDINGS AND MATERIALS

Photographs and audio or video recordings of the client may be made or used for assessment or therapy purposes only where there is an appropriate legal basis.

Use of the client's image or recordings for marketing or promotional purposes, on the website or on social media requires separate consent, where such consent is required by law.

Refusing consent to the use of the client's image for marketing purposes does not affect the ability to use the Practice's services.

19. THERAPY MATERIALS

Materials given to the client for practice at home are intended primarily for their own therapeutic use.

Copyright-protected materials may not be distributed, published, sold or made publicly available without the author's consent in a manner that infringes copyright.

20. RESPONSIBILITIES OF THE CLIENT OR PARENT

The client or their parent/legal guardian is required to provide true and relevant information that may affect the assessment or therapy.

This applies in particular to relevant information concerning health, hearing, development, previous examinations and recommendations from other specialists.

If their contact details change, the client or parent/legal guardian should inform the Practice.

21. COMPLAINTS AND FEEDBACK

If the client or their parent/legal guardian has any comments or concerns about the services provided, they are asked first to contact the Practice so that the matter can be clarified.

Where specific rules on the handling of complaints in healthcare apply to a given situation, the client retains all rights arising from those rules.

22. CHANGES TO THESE TERMS AND CONDITIONS

The Practice may update these Terms and Conditions in the event of changes in legislation, work organisation, the scope of services or the rules under which services are provided.

In the case of changes affecting ongoing cooperation, the client will be informed of the new terms before they take effect, to the extent required by law.

The current version of these Terms and Conditions is available on the Practice's website.
